Alberta Health Services (AHS) has an exciting opportunity for a Legal Counsel within our Labour & Employment team. Reporting to the Associate General Counsel, Labour & Employment (AGC), the Legal Counsel, Labour & Employment (Legal Counsel) provides effective legal advice, outlines rights, obligations and liabilities, and identifies solutions on complex and time-sensitive labour and employment matters to managers, human resources business partners, labour relations advisors and other professionals in all AHS divisions. This position will have independent carriage of assigned labour and employment legal files, and will represent the interests of AHS in labour arbitration hearings, applications in court and hearings before other administrative tribunals throughout the Province as required. Location of the position is negotiable in either of the Legal & Privacy offices in Calgary or Edmonton with travel across Alberta as necessary. Description:

The Legal Counsel Labour & Employment (Legal Counsel) represents AHS before arbitrators in labour arbitration hearings, administrative tribunals and Court, throughout the Province; is accountable for assigned legal files, matters or issues; and works with clients and witnesses in preparation for hearings. The Legal Counsel provides accurate, concise, and practical advice to clients to address specific facts and legal issues which may be of complex and sensitive nature, while supporting the service delivery model, guiding principles and vision of the Legal & Privacy Department and AHS. While outlining rights, obligations and liabilities to all parties involved, the Legal Counsel also handles inquiries from clients independently, escalating to the AGC as appropriate. Critical to the role is the ability to formulate legal solutions and balance business requirements against legal risks. As a member of the Legal & Privacy Department, the Legal Counsel will identify service delivery, business and operational issues, and consult with other professionals within AHS and/or Legal & Privacy as necessary. The Legal Counsel conducts legal research in preparation for arbitrations and other hearings; provides legal opinions and memoranda in an independent manner for clients, the AGC, the General Counsel (GC) and other senior management; and educates clients and partners on developments and changes to legislation and legal jurisprudence. The Legal Counsel fosters and maintains positive and effective relationships with internal and external stakeholders and partners across the province such as external counsel, unions, arbitrators, Alberta labor relations board, and Alberta human rights commission and designated clients.

Required Qualifications:

A member in good standing with the Law Society of Alberta entitled to practice in Alberta. With a Law degree from a recognized university and a minimum of 5 years of legal practice, you have experience with labour, employment, human rights and privacy in a unionized environment. You have knowledge and experience with applicable legislation including the Alberta Labour Relations Code, Employment Standards Code, and the Alberta Human Rights Act. The equivalencies in experience may be considered.

Preferred Qualifications:

Previous experience representing clients in administrative tribunals, arbitrations and litigation is preferred, however desire and aptitude for oral advocacy in administrative tribunals, arbitrations and litigation is necessary. Knowledge and experience of the Freedom of Information and Protection of Privacy Act, as well as experience working in the public sector is preferred.
