Job description: Reporting to the Senior Legal Counsel and Executive Director, Medical Affairs and Physician Services, the Legal Counsel, Physician and Medical Staff Services provides legal support and advice in the development and negotiation of complex and non-standard physician service contracts/salary offers with and on behalf of PHSA. The Legal Counsel, Physician Services reviews and drafts complex and non-standard contracts for medical staff and provides legal advice on interpretation and application of relevant federal and provincial legislation, regulations and agreements, as well as PHSA Rules, Bylaws, policies, terms and conditions. The Legal Counsel, Physician Services advises, negotiates and collaborates extensively with other internal and external stakeholders: consults and provides legal advice internally with PHSA’s Physician Compensation Office, PHSA leadership/medical administration staff and other Corporate Departments; and negotiates, consults and collaborates externally with Doctors of BC, MoH, HEABC Physician Secretariat, University of BC (UBC), and the College of Physicians and Surgeons of BC (RCPS and CCFP). The position supports the Senior Legal Counsel and Executive Director, Medical Affairs and Physician Services in providing legal support to PHSA stakeholders on matters relating to its medical staff governance and contracts.

What you’ll do

  • Provide expert legal advice to PHSA’s Physician Compensation Office in the development, drafting and negotiation of physician service contracts and salary agreements within the context of Physician Master Agreement (PMA)/Alternative Payments Subsidiary Agreement, PHSA policies, Medical Staff Bylaws/Rules, MoH policies, UBC policies and HEABC Medical Leadership/Administration Compensation Guidelines. Provide legal advice on physician management issues including internal grid payment structures, service deliverables, reporting requirements, terminations and contract renewals.
  • Provide expert legal support and guidance to internal PHSA stakeholders on the development of solutions for non-standard physician agreements and issues related to employment or termination of physician contracts. Liaise externally with HEABC Physician Secretariat on complex, industry issues involving interpretation and application of Physician Master Agreement.
  • In partnership with PHSA’s Physician Compensation Office, collaborate with UBC Departments, UBC Finance and PHSA Finance to draft, and finalize secondment agreements, partner institution appointment support letters, funding letters and agreements and other documentation required to address complex funding and payment arrangements across institutions.
  • Anticipate and identify legal issues; review, research and prepare legal opinions; and advise PHSA stakeholders on legal strategies and solutions to mitigate legal risk, on matters that may have significant impact to the administration and management of medical staff contracts by PHSA as well as general matters related to medical staff relations and governance.
  • Advise PHSA stakeholders on the application of new and existing healthcare legislation applicable to medical staff and the impact to PHSA, programs and services, and medical staff.
  • Represent PHSA at hearings, court and/or tribunals arising from the administration of medical staff contracts.
  • Assist Senior Legal Counsel and Executive Director, Medical Affairs and Physician Services in providing legal advice and support for other matters related to medical staff governance and contractual arrangements.

What you bring

A law Degree from a recognized University supplemented by a minimum of five (5) years’ recent, related experience. Experience in healthcare and a degree in Business Administration and/or knowledge of business management an asset.

A current membership in good standing of the Law Society of British Columbia or eligible for membership within a specified period.

Expertise in negotiating and drafting legal documents. Substantial knowledge of and demonstrated familiarity with the legislative and regulatory framework governing healthcare. Expertise in analyzing, researching, evaluating and interpreting legal issues. Expertise in providing legal opinions and advice taking into account and understanding the needs of others to achieve helpful results. Highly developed business writing and verbal communication skills including the ability to facilitate, negotiate, persuade others, and encourage cooperation between diverse operational groups and skill sets and to work collaboratively to problem-solve, design and implement solutions. Ability to respond to the needs of stakeholders supported by an acute awareness of the impact of actions. Demonstrated ability to exercise tact, good judgment and initiative.
